Recent Matters:  

February 2016,
Clackamas County (Domestic Relations). Opposing expert opined that business in question had a FMV of 3X Revenues based on a three year old tax return.  The testimony given was that a dated tax return is insufficient to develop a FMV or a broker opinion of value.  Broker data suggested that the rules of thumb had a range and we analyzed how outliers impacted these values.  The transactional data--which discredited the other expert-- was presented to the court and it was up to the court to determine what the value to use or develop based on the evidence presented

Okanogan County, State of Washington. Marital dissolution action. Value of business with real estate.

March 2014, Lane County, Oregon (consulting witness in a civil where defendant counter claimed and claimed actions taken by a landlord resulted in the failure of the business; prepared attorney to cross-examine the valuation and damages experts. Matter settled.

A through understanding of the technical filed and use of quantitative methods/empirical modeling is indispensable to succeed here.  A proactive approach entails an initial cost, but it may ultimately lead to settlement even before a deposition or dismissal of the matter.  In the vent the matter goes to trial, the attorney can choose to remain with the consulting expert as the testifying expert or retain an separate testifying expert.


We have the experience (having tried cases and assisted counsel as consulting expert) in the following types of cases:

Caveat: Not all suits merit an expert (consulting or testifying) and we will advise of such after assessing the facts provided and interviewing witnesses.  If a proactive approach is not taken, we can provide limited assistance in the form of preparing counsel to cross-examine the opposing expert.  We will also pass on some engagements; one recent one was counsel in UT for a non-profit "run to the ground" that sought "lost profits".
